Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Upoznajme mobile application (Android / iOS) and the website upoznajme.app (collectively, the "Service"), operated by UPOZNAJME LTD, 71–75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom (Company No. 17036598).

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

• You must be at least 18 years old to use Upoznajme.
• You must provide accurate and truthful information during registration.
• You represent that you are not prohibited from using the Service under any applicable laws.
• If we discover that an account belongs to someone under 18, we will terminate it immediately and delete all associated data.

2. Your Account

• You are responsible for keeping your login credentials secure. Do not share your password.
• You are responsible for all activity that occurs under your account.
• You may only create one personal account. Duplicate or impersonation accounts are prohibited.
• If you suspect unauthorised access to your account, contact us immediately at info@upoznajme.app.

3. Acceptable Use

When using Upoznajme you agree not to:

• Harass, threaten, bully, or intimidate other users.
• Post or transmit hate speech, discriminatory content, or content that incites violence based on race, ethnicity, religion, gender, sexual orientation, or disability.
• Impersonate any person or entity, or falsely represent your affiliation.
• Upload, share, or distribute any sexually explicit, pornographic, or NSFW content. All uploaded images are screened automatically.
• Spam, send unsolicited promotional messages, or engage in commercial solicitation through the chat feature.
• Scrape, crawl, or otherwise harvest data from the Service without authorisation.
• Attempt to gain unauthorised access to any part of the Service, its servers, or other users' accounts.
• Use the Service to facilitate illegal activities, including fraud, money laundering, or trafficking.
• Upload content that infringes third-party intellectual property rights.
• Distribute malware, viruses, or any other harmful code.

3A. Child Safety & CSAE Policy

3A.1 Prohibited Conduct

The following activities are strictly prohibited on the Upoznajme platform and will result in immediate and permanent account termination without prior warning:

• Creating, uploading, sharing, distributing, or soliciting any content that depicts, promotes, or facilitates the sexual abuse or exploitation of children.
• Child Sexual Abuse Material (CSAM): Any visual depiction of sexually explicit conduct involving a minor, including photographs, videos, computer-generated imagery, or digitally altered images.
• Child grooming: Befriending or establishing an emotional connection with a child online or offline with the intent of facilitating sexual contact, abuse, or the exchange of sexual imagery.
• Sexualisation of minors: Any imagery, content, or language that depicts, encourages, or promotes the sexual abuse of children or portrays children in a manner that could result in their sexual exploitation.
• Sextortion: Threatening or blackmailing a child by using real or alleged access to a child's intimate images.
• Child trafficking: Advertising, soliciting, or facilitating the trafficking of a child for commercial sexual exploitation or any other purpose.
• Predatory behaviour: Any inappropriate interaction targeted at a minor, including but not limited to soliciting personal information, arranging meetings, or sending explicit content to minors.

3A.2 Age Restriction

Upoznajme is exclusively intended for users aged 18 years and older. If we become aware that a user is under 18, we will immediately terminate their account and delete all associated data without prior notice. Users who misrepresent their age will be permanently banned.

3A.3 Reporting & Enforcement

• Users can report suspected CSAE content or behaviour at any time through the in-app reporting function (available on every profile and in every chat).
• All reports related to child safety are prioritised and reviewed within 24 hours.
• Upon obtaining actual knowledge of CSAM on the Upoznajme platform, we will immediately remove the content, permanently suspend the offending account, and preserve evidence for law enforcement.
• Confirmed CSAM is reported to the National Center for Missing & Exploited Children (NCMEC) and/or the relevant regional authority in accordance with applicable laws.
• We cooperate fully with law enforcement agencies investigating child exploitation.

3A.4 Child Safety Point of Contact

UPOZNAJME LTD designates the following point of contact for all child safety matters, including notifications from Google Play about CSAE content:

This representative is authorised to speak to our enforcement and review procedures and to take immediate action when required.

4. User Content

4.1 Your Content

You retain ownership of content you upload (photos, profile text, posts in Moj Krug, messages). By uploading content to the Service, you grant UPOZNAJME LTD a non-exclusive, worldwide, royalty-free, sublicensable licence to store, display, and distribute that content solely to operate and improve the Service.

4.2 Content Standards

All content you submit must comply with Section 3 (Acceptable Use). In particular:

• Profile photos must show a real, recognisable image of yourself.
• You may not use photos of other people without their consent.
• Content in the Moj Krug social feed must not be sexually explicit, violent, or otherwise harmful.

4.3 Content Moderation

We use automated screening (NSFW detection) on uploaded images and reserve the right to remove any content that violates these Terms, in our sole discretion, without prior notice.

5. Moj Krug (Social Feed)

Moj Krug is a community feed within the app. In addition to the general rules in Sections 3 and 4, the following applies:

• Posts and stories are visible to other registered users of the Service.
• Location check-ins attached to posts are voluntary; you control what location data you share.
• Other users may like or comment on your posts. You may delete your own content at any time.
• Repeated misuse of the feed (spam, NSFW posts) may result in account suspension.

6. Intellectual Property

The Upoznajme name, logo, design, and all software (excluding user-generated content) are the exclusive property of UPOZNAJME LTD and are protected by copyright, trademark, and other intellectual-property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

7. Advertising

The free version of Upoznajme displays advertisements via Google AdMob. By using the free tier you acknowledge that ads may be shown. Personalised advertising requires your prior consent as described in our Privacy Policy. A future premium/subscription tier may remove advertisements.

8. Moderation & Enforcement

We reserve the right to, without notice or liability:

• Remove or edit any user content that violates these Terms.
• Temporarily limit or permanently suspend access to the Service for any user who violates these Terms.
• Report illegal activity to the relevant law-enforcement authorities.

We do not guarantee that all violations will be detected or acted upon. Users are encouraged to use the in-app Report function to flag content or behaviour that violates these Terms.

9. Account Termination

9.1 Termination by You

You may delete your account at any time through the app settings. Upon deletion your profile and content are removed from active systems within 30 days in accordance with our Privacy Policy.

9.2 Termination by Us

We may suspend or permanently terminate your account if you breach these Terms, if required by law, or if continued operation poses a legal or safety risk. We will, where reasonably practicable, give you notice before terminating your account.

10. Disclaimers

Upoznajme is a platform for meeting people. We are not responsible for the actions, content, or safety of individual users. Always exercise caution when meeting someone from the app in person.

11. Limitation of Liability

To the maximum extent permitted by law, UPOZNAJME LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use or inability to use the Service, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising out of these Terms or the Service shall not exceed £50 GBP (or the amount you paid to us in the preceding 12 months, whichever is greater).

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other matter that cannot be excluded under English law.

12. Indemnification

You agree to indemnify, defend, and hold harmless UPOZNAJME LTD and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of: (a) your use of the Service; (b) your violation of these Terms; or (c) your content.

13. Third-Party Links & Services

The Service may contain links to third-party websites or services (e.g. Instagram, TikTok). These links are provided for convenience only. We do not control and are not responsible for the content or practices of any third-party sites.

14. Changes to These Terms

We may revise these Terms from time to time. When we make material changes we will notify you via an in-app notice or email at least 14 days before the new Terms take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

15. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory local consumer-protection laws in your country of residence apply.

If you are a consumer resident in the EU, the European Online Dispute Resolution platform is available to you.
